1Scope & Global Application
This Fair Use Policy ("Policy") governs the use of all services provided by Neon Next Generation PTY LTD ("Neon," "we," "us," "our"), including VPS, Web Hosting, Proxy, VPN, and any related infrastructure services (collectively, "Services").
This Policy applies to all customers, users, resellers, and end users worldwide, regardless of location, nationality, or jurisdiction. It forms part of and must be read alongside our:
Where your local mandatory law provides rights that exceed what is stated in this Policy, those rights apply in addition to this Policy and are not waived. If any provision of this Policy is unenforceable in your jurisdiction, it shall be modified to the minimum extent necessary, or severed, without affecting the remainder of this Policy.
2Acceptable Use
Our Services may only be used for lawful purposes. You MAY use our Services to:
- Host websites, applications, and databases for legitimate business or personal use.
- Run authorised VPN or proxy services for lawful personal or commercial use.
- Deploy software applications within the resource limits of your plan.
- Store and transmit data lawfully in accordance with all applicable laws.
- Conduct authorised penetration testing on systems you own or have written permission to test.
All use of our Services must comply with the laws of Australia (our place of incorporation), the laws of your jurisdiction, and any applicable international laws and conventions. Where your jurisdiction imposes additional restrictions on acceptable use, those restrictions apply to your use of our Services.
3Performance & Resource Allocation
Neon Next Generation provides high-performance infrastructure designed for enterprise-level stability, flexibility, and reliability. Resource usage rules depend on the service type purchased.
We reserve the right to monitor aggregate resource usage to ensure platform stability for all customers. Where usage patterns are found to negatively impact other users or our infrastructure, we will contact the responsible customer and may implement temporary throttling pending resolution. All monitoring is conducted in accordance with our Privacy Policy.
4VPS Services
Dedicated Resource Isolation
VPS services use hardware-level virtualisation to ensure CPU cores, RAM, and storage allocation are isolated to your virtual machine. Resources are not shared with other customers on the same host beyond the defined hypervisor allocation.
100% Resource Guarantee
Customers using VPS services are permitted to utilise 100% of their allocated CPU and RAM at all times. Neon does not throttle VPS resources provided that:
- Usage remains within the purchased plan limits.
- Activity complies with this Policy and our Terms of Service.
- Workloads do not attempt to exploit or destabilise host infrastructure.
Dedicated IP Allocation
All VPS services include dedicated IPv4 and/or IPv6 addresses. This means:
- Each VPS receives its own unique IP address(es).
- IPs are not shared between customers.
- Customers are responsible for all traffic originating from their assigned IPs, including traffic routed through any hosted software.
Backups
All VPS plans include dedicated weekly automated backups. You may also perform manual backups at any time via your account dashboard. Customers are encouraged to maintain their own independent backups. Neon is not liable for data loss resulting from hardware failure, customer action, policy violations, or service suspension.
6Network Bandwidth
Neon infrastructure provides high-performance network connectivity. Network speeds are structured as follows:
| Tier | Speed |
| Base Speed | 1 Gbps — guaranteed for all plans |
| Burst Capability | Up to 10 Gbps during low network utilisation — not guaranteed |
Burst speeds are not guaranteed and depend on:
- Datacentre capacity at the time of use.
- Network congestion across the infrastructure.
- Node-level traffic load from other customers.
Customers may not generate traffic intended to degrade network performance, saturate shared network links, or disrupt other services. Any traffic that adversely impacts the network may be rate-limited or blocked without prior notice.
7Hardware Integrity & Longevity
Neon must protect the long-term stability of its infrastructure and storage systems to ensure reliable service for all customers.
Cryptocurrency Mining
The use of Neon Services for Proof-of-Work cryptocurrency mining is strictly prohibited on all plans, including VPS. These workloads cause sustained hardware stress, excessive disk wear, and elevated thermal output incompatible with shared and virtualised infrastructure. Detection of mining activity will result in immediate suspension without refund.
Hypervisor Safety
Any attempt to interfere with or exploit virtualisation systems is prohibited, including:
- Hypervisor escape attempts or container breakout exploits.
- Side-channel attacks targeting other virtual machines on the same host.
- Deliberate resource starvation or "noisy neighbour" abuse.
- Attempts to access or manipulate the host operating system or other VMs.
Disk I/O Abuse
Workloads generating extreme sustained disk I/O that negatively impact other customers may be restricted. Neon may require:
- Workload optimisation within a specified timeframe.
- Migration to a dedicated storage solution.
- Service plan adjustment to a higher tier.
8Network & Proxy Standards
Neon Next Generation permits and supports the operation of VPN and proxy services for lawful purposes. Operation of such services is subject to the following standards.
Traffic Responsibility
Customers are fully responsible for all traffic originating from their VPS IPs, including traffic routed through proxy or VPN software hosted on our infrastructure. This responsibility extends to end users of any service you operate on our platform.
Abuse Response Timeframes
If a service is flagged for malicious activity — including botnet traffic, brute-force attempts, or abuse reports from third parties — the customer must:
- Acknowledge the notification within 4 hours of receipt.
- Mitigate the issue within 12 hours of notification.
- Provide a written summary of the cause and remediation steps taken.
Failure to respond within these timeframes may result in immediate service suspension.
IP Reputation Protection
If customer activity results in Neon IP addresses being listed on abuse blacklists or RBLs:
- Investigation and remediation may be required at the customer's expense of effort.
- Services may be suspended until the IP reputation is restored.
- Repeat or severe cases may require service migration, IP reassignment, or restriction.
Open Proxy Risk
Public or unauthenticated open proxies are strongly discouraged due to high abuse potential. Customers running proxy services should implement at minimum:
- Authentication systems to restrict access to authorised users.
- Rate limiting to prevent abuse of the service.
- Abuse monitoring and alerting tools.
- Connection logging where permitted by applicable law.
Tor Exit Nodes
The operation of Tor exit nodes on Neon infrastructure is prohibited. Tor relay nodes (non-exit) may be permitted on a case-by-case basis with prior written approval. Contact contact@neonnextgeneration.com to discuss.
9Security & Compromised Systems
Customers are responsible for securing all systems deployed on Neon infrastructure. Security obligations include:
- Keeping all software, operating systems, and packages updated with security patches.
- Using firewalls and appropriate security controls to limit exposure.
- Protecting credentials and API keys from unauthorised disclosure.
- Disabling or removing unused services and open ports.
- Implementing access controls and authentication on all exposed services.
Compromised System Response
If a VPS or service is found to be compromised or is actively participating in malicious activity (e.g., sending spam, participating in a botnet, or being used as a DDoS amplifier), Neon may temporarily suspend the service immediately to protect network stability and other customers. You will be notified as soon as practicable. Restoration of service is contingent on demonstration that the compromise has been resolved.
Authorised Security Testing
Penetration testing and vulnerability scanning is permitted only on systems you own or have written authorisation to test. Any security testing that targets Neon infrastructure, other customers' systems, or third-party services without authorisation is strictly prohibited and will result in immediate termination.
10Strict Prohibitions (Zero Tolerance)
⚠ The following activities will result in immediate termination without refund and may be reported to relevant law enforcement authorities.
Illegal Content
- Hosting, distributing, or storing Child Sexual Abuse Material (CSAM) or any content that sexually exploits minors. Such activity will be reported to relevant law enforcement and NCMEC.
- Hosting any content that is illegal under applicable law in Australia or the customer's jurisdiction.

Malicious Infrastructure
Services may not be used for:
- Botnet command and control (C2) infrastructure.
- Malware, ransomware, or spyware distribution or hosting.
- Phishing pages, scam platforms, or fraudulent storefronts.
- Credential harvesting, keylogging, or data exfiltration systems.
- Exploit kits or vulnerability scanning tools used against unauthorised targets.
Network Attacks
Using Neon infrastructure to attack other systems is prohibited, including:
- DDoS attacks or amplification attacks against any target.
- Unauthorised port scanning or network probing of third-party systems.
- Brute-force login attempts against any system you do not own.
- Man-in-the-middle attacks or traffic interception.
Spam & Unsolicited Communications
Sending unsolicited bulk email (spam) is strictly prohibited. All email marketing sent through our infrastructure must:
- Use double opt-in consent confirmation for all mailing lists.
- Include a clear and functional unsubscribe mechanism in every communication.
- Comply with all applicable anti-spam laws (including Australia's Spam Act 2003, CAN-SPAM, CASL, and equivalent laws in your jurisdiction).
- Not use harvested, purchased, or scraped email lists.
Cryptocurrency Mining
Proof-of-Work cryptocurrency mining is strictly prohibited on all Neon service tiers. This includes but is not limited to mining of Bitcoin, Monero, Ethereum Classic, or any other PoW cryptocurrency. Detection of mining activity will result in immediate termination without refund.
11Content Standards
All content hosted on or transmitted through Neon infrastructure must comply with applicable law. The following content standards apply globally to all customers.
Prohibited Content
- Child sexual abuse material (CSAM) or any content sexually exploiting minors.
- Content that incites violence, terrorism, or hatred based on protected characteristics.
- Content that infringes the intellectual property rights of any third party.
- Content that is defamatory, fraudulent, or constitutes unlawful harassment.
- Content that violates any applicable law in Australia or the customer's jurisdiction.
Adult Content
Adult content (18+) is permitted on VPS plans only where: (a) it is legal in the customer's jurisdiction and in Australia; (b) proper age verification is implemented for end users; (c) it does not involve minors in any form. Adult content is not permitted on shared hosting plans. Neon reserves the right to request evidence of legal compliance at any time.
AI-Generated Content
AI-generated content hosted on our infrastructure is subject to the same content standards as all other content. You may not use our Services to train AI or machine learning models on content you do not own or have rights to use for that purpose.

Where permitted by law, we will notify affected customers of such requests before compliance. Copyright claims are handled under our DMCA process — see Section 12.
Global Consumer Rights
Nothing in this Policy limits any mandatory rights you have under the consumer protection laws of your jurisdiction. Users in jurisdictions with statutory consumer protection rights (including Australian Consumer Law, EU consumer law, UK Consumer Rights Act, and equivalent laws) retain those rights regardless of the provisions of this Policy.
